Please read these Terms and conditions of use (‘Terms’) carefully before using the health Worldl website at www.thehealthworld.org (‘The health World’).
In these Terms, “you” and “your(s)” refer to the person or organisation accessing and using the health Worldl website. “We”, “us” and “our” refer to the State of Victoria, Australia, including the Victorian Department of Health & Human Services and the health Worldl.
The State of Victoria, Australia (‘State of Victoria’) owns the health Worldl. the health Worldl is primarily created and maintained for people who live in Australia.
You may only access and use the health Worldl if you agree to be legally bound by these Terms. If you do not agree to be legally bound by these Terms, please do not access and/or use www.thehealthworld.org. You will be deemed to have accepted these Terms if you commence or continue to access and use the health Worldl, and you will continue to be bound by these Terms for so long as you access or use the health Worldl.
Changes to these Terms
The State of Victoria may make changes to the health Worldl, including these Terms, at any time. You agree that you will be legally bound by the updated or amended Terms from the first time you use the health Worldl after the updated version is published on www.thehealthworld.org.
Copyright in the health Worldl (including content, applications and design) is owned by the State of Victoria or is used by the State of Victoria under licence. All copyrighted material is protected by Australian and international copyright and other intellectual property laws.
Apart from fair dealing for the purposes of private study, research, criticism or review, as permitted under the Copyright Act 1968 (Cth), and apart from uses specifically authorised by these Terms, you may not in any form or by any means adapt, reproduce, store, create derivative works, distribute, print, display, perform, publish or commercialise any information, products or services obtained from any part of the health Worldl without written permission from the State of Victoria, obtained through the Department of Health & Human Services. The State of Victoria reserves the right to grant or refuse permission or to impose any conditions on any permission that is granted. To obtain permission you must request permission in writing. the health Worldl Reproduction request form will assist you.
The ‘the health World’ mark (name) and device (logo) are trademarks owned by the State of Victoria. Any trade marks or registered trade marks (including other logos) that appear on the health Worldl are the property of the State of Victoria and/or third parties. They cannot be copied, modified, reproduced, published, uploaded, distributed or posted in whole or in part in any way without the prior written consent of the State of Victoria, obtained through the Department of Health & Human Services, and/or the relevant third party, except where specifically allowed for elsewhere in these Terms.
All information published on the health Worldl is accurate at the time of publication. While the information on the health Worldl has been researched, reviewed and presented with all due care, the content is provided for general education and information only.
Information on the health Worldl is not intended to replace medical advice from a health professional and the State of Victoria does not accept any liability for any error or omission, injury, expense, loss or damage incurred by you or another party as a result of you using or relying on any information contained on the health Worldl website or any linked website.
All users are urged to seek advice from a qualified health care professional for diagnosis and answers to their medical questions.

Liability and loss – disclaimer
The State of Victoria does not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of the health Worldl or any linked website, nor does it accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through the health Worldl or any third party website that you access through a link contained on the health Worldl.
To the extent permitted by law, the State of Victoria excludes any liability to you for any of the following types of loss or damage (which you may suffer as a result of your use of the health Worldl) whether the losses were foreseen, foreseeable, unforeseen, unforeseeable, known, unknown or otherwise: a.any loss which arose when you first accessed the health Worldl (even if that loss results from failure to comply with these Terms or negligence on the part of the State of Victoria);
b.any loss due to the health Worldl not being available at any particular time;
c.any business loss you may suffer, including loss of revenue, loss of profits or loss of anticipated savings (whether those losses are the direct or indirect result of default on the part of the State of Victoria);
d.any loss which you suffer other than as a result of the State of Victoria’s failure to comply with these Terms or its negligence or breach of statutory duty;
e.any loss suffered due to the default of any party other than the State of Victoria;
f.any loss due to the non-availability or failure of any telecommunications or computer services, systems, equipment or software operated or provided by you or any third party;
g.any loss or damage caused by any other event not reasonably within the control of the Department of Health & Human Services.
Printing from the health Worldl
You may download and print information from the health Worldl providing you retain all branding, design and logos that appear on the relevant page and any copyright statements, credits, references to the health World and any other notices that appear on the relevant page. You can do this by using the ‘print’ button on each the health World web page.
Even if you print material from the health Worldl as allowed under clause 13, above, you must not use or distribute any material from the health Worldl for any public or commercial purpose without express written permission from the State of Victoria, obtained through the Department of Health & Human Services. The State of Victoria reserves the right to grant or refuse permission, and to impose conditions on any permission that is granted. Please refer to clause 5, above.
Amending or editing the health World information
Due to the health Worldl’s strict clinical review processes and copyright arrangements, you may not modify, adapt, amend, edit, and then reuse information available on the health Worldl without express written permission from the State of Victoria, obtained through the Department of Health & Human Services. The State of Victoria reserves the right to grant or refuse permission and to impose conditions on any permission that is granted. Please refer to clause 5, above.
Reproducing information from the health Worldl on the Internet
You may not reproduce on the Internet any information or material available on the health Worldl unless the reproduction is authorised: a.under a Standard Licence Agreement or other legal arrangement issued by the health Worldl or Department of Health & Human Services; or
b.by clause 17 below.
The Internet includes websites, portals, feeds, email, blogs, mobile devices and any other Internet platforms (that exist now or in the future).
Without limiting the statement contained in clause 16 above, you may do any of the following without seeking permission, providing you comply with these Terms: a.Include a link on your website to the relevant page on the health Worldl, providing you comply with clauses 25 and 26 below.
b.Reproduce one or two direct quotes from a fact sheet (with quotation marks) and cite the health Worldl as your reference. These can only be short, direct quotes and should follow normal referencing conventions.
c.Write your own original content and use information on the health Worldl as a reference with the following acknowledgement, “Reference: www.thehealthworld.org”, which must operate as a hyperlink to the health Worldl.
Reproducing the health World information in other publications and formats
You may reproduce information available on the health Worldl in publications and formats other than the Internet only with express written permission from the State of Victoria, obtained through the Department of Health & Human Services. To obtain permission, you must request permission in writing and provide specific details about how and where you will reproduce the material, and the purpose of the proposed reproduction. The State of Victoria reserves the right to grant, withdraw or refuse permission, and to impose conditions on any permission that is granted.
If you are granted permission to reproduce information or material from the health Worldl in a publication or format other than the Internet, you will be required to sign a Standard Licence Agreement outlining the specific terms and conditions of the reproduction.
Really Simple Syndication (RSS)
The State of Victoria may offer RSS feeds and widgets that allow you, on a non-exclusive basis, to display on your website or digital device the information and/or material that you select to receive via RSS from www.thehealthworld.org. All intellectual property rights in the material received through the RSS feed remain the property of the State of Victoria and/or its licensors. See clause 5 above.
You do not need to obtain permission to use our RSS feeds or widgets, provided you comply with these Terms.
If you wish to syndicate material from the health Worldl in any way other than through an RSS feed, you will need to seek permission from the State of Victoria, through the Department of Health & Human Services, and licence fees may apply. Please see clause 5, above.
Links to other websites
Links to other websites are provided on the health Worldl for the convenience of users. The inclusion of a link does not imply endorsement of the content of the external site by the health Worldl, the Department of Health & Human Services or the State of Victoria. The State of Victoria takes no responsibility for the accuracy, currency, reliability and correctness of any information contained on third party websites, or whether the information contained on those websites is suitable for your needs. The State of Victoria takes no responsibility and accepts no liability for the services provided by any third parties and/or their websites whose hyperlink or trade name may appear on the health Worldl.
The State of Victoria publishes links to other websites on the health Worldl at its own discretion and reserves the right to revise or amend links to other websites or withdraw links at any time without notice.
Links to the health Worldl
You may insert a link to the health Worldl on your website, provided that you comply with these Terms and with the following conditions: a.The link cannot be used in any manner that may indicate endorsement, approval or sponsorship of your website, your organisation or its services by the health Worldl, its content partners, the Department of Health & Human Services or the State of Victoria. See clause 27, below.
b.If there are fees involved in the use of any part of your website, your website should contain a written notice that the health Worldl is a free service provided by the Victorian Government.
c.No charge of any sort can be attached to the availability of the health Worldl. For example, if you have a subscription section on your site, the health Worldl link must not be placed inside this subscription area.
d.The link to the health Worldl website cannot be attached to any revenue generating mechanism.
e.The State of Victoria reserves the right to request the removal of a link on your website to the health Worldl at any time. Any link to the health Worldl must be immediately removed from your website upon request from the Department of Health & Human Services.
f.The words ‘the health World’ or the url www.thehealthworld.org must be part of the link text.
You must not reproduce the entire the health World environment and/or its contents or services within another website, for example by using I-frame or screen scraping techniques.
Under no circumstances can you use any the health World content or material including any trade name, logo, URL or other device that appears on the health Worldl, in any manner that may suggest any endorsement of your company, your website or your products and services by the health Worldl, its content partners, the Department of Health & Human Services or the State of Victoria.
Material generated by users
The State of Victoria may publish on the health Worldl any material uploaded, posted, emailed or otherwise submitted by you and other users (‘User Generated Material’). This includes text, illustrations, photos, graphics, audio, video or other material generated by you or other users.
All User Generated Material published on the health Worldl is at the sole discretion of the Department of Health & Human Services. It may remain on the health Worldl for an indefinite period or may be removed at any time, at the sole discretion of the Department of Health & Human Services.
User Generated Material reflects the individual opinions or views of the relevant user. The State of Victoria, Department of Health & Human Services and the health World do not endorse any advice or opinions contained in any User Generated Material.
the health Worldl may monitor, moderate or exercise editorial control over User Generated Material and reserves the right but not the obligation to assess or examine the material when it is submitted.
The State of Victoria will not publish User Generated Material or will remove User Generated Material from the health Worldl if, in the opinion of the Department of Health & Human Services, that User Generated Material is: a.incompatible with any Department of Health & Human Services or Victorian Government policy;
b.misleading or false, or impersonating another living person;
c.potentially libellous or defamatory;
d.abusive, threatening, harassing, hateful, insulting, offensive, obscene, blasphemous or racially vilifying. For example, if your nickname is inappropriate or obscene your material may not be published;
e.of nuisance value, inappropriate, off topic or vexatious;
f.spam, promotes a product or commercial service, or solicits business;
g.compromises your privacy or that of someone else, or breaches confidentiality;
h.deliberately provocative of other community members.
When submitting User Generated Material you must provide a genuine email address. This is in case it is necessary to clarify any information or follow up an issue with you. Only first names or your preferred pseudonym (nickname) will be published on the health Worldl. Your personal information will be dealt with in accordance with clauses 39 and 40, below.
By submitting User Generated Material to the health Worldl, you consent to the State of Victoria (including the health Worldl and the Department of Health & Human Services) doing or omitting to do anything that, but for this consent, would constitute an infringement of your moral rights in the material (as defined by the Copyright Act 1968). This includes reproducing, publishing, performing, transmitting, exhibiting, adapting, altering or in any way changing or using the material: a.with or without attribution of authorship;
b.with or without any other materials comprising copyright;
c.with or without any other text, data, sounds or images;
d.with no title, the same title or any other title;
e.in any medium or context,
f.in any way that the State of Victoria (including the health Worldl and the Department of Health & Human Services) sees fit.
In submitting your User Generated Material to the health Worldl, you grant to the State of Victoria a worldwide, royalty-free, perpetual licence to use, reproduce, edit, modify and exploit the User Generated Material that you submit, in any form or on any medium and for any purpose, including but not limited to: a.posting the User Generated Material on the health Worldl website or publishing or disseminating it in a the health World publication, or using other technology now known or developed in the future;
b.using the User Generated Material in any promotions and marketing for the health Worldl; and
c.sub-licensing the User Generated Material to third parties.
By submitting your material to the health Worldl you acknowledge and you warrant to the State of Victoria that: a.Your material is original, you own the copyright in your material and have the authority to grant a licence to the State of Victoria as outlined in clause 35 above.
b.Your material is not confidential and does not contain anything that is obscene, pornographic, defamatory or in breach of any law or regulation.
c.You have obtained the consent of anyone who is identifiable in your contribution for their personal details to be included in your contribution, or the consent of their parent or guardian if they are under 16.
d.You acknowledge and agree that the State of Victoria publishes your material on the health Worldl at its own discretion and is not obliged to publish or use all or any of the material you submit to the health Worldl.
By submitting material to the health Worldl you agree to indemnify the State of Victoria against all liability arising from any claims against the State of Victoria by third parties for loss or damage that arises from that material being displayed on the health Worldl. This means that if a third party makes a claim against the State of Victoria that relates to the material that you have submitted, you agree to reimburse the State of Victoria for any loss or damage that it suffers as a result of that claim. Examples of when this might occur include: if the material is inaccurate or defamatory; or if the dissemination of the material is a breach of confidentiality or privacy, or an infringement of the intellectual property rights of a third party.
If you do not agree with the terms set out above, please do not submit or share your contribution with the health Worldl. By submitting your material to the health Worldl you will be deemed to have accepted the terms set out in clauses 28 to 37 above.
Personal information and privacy
the health Worldl is committed to ensuring that your personal information is protected. If you provide information to the health Worldl by which your identity can reasonably be ascertained, it will only be used in accordance with the Information Privacy Act 2001 (Vic) and the Department of Health & Human Services privacy statement.
The State of Victoria will use the information you provide to the health Worldl to provide and operate the health Worldl, to fulfil administrative functions associated with the health Worldl, and for internal research and reporting purposes. Where you provide personal information to the health Worldl, you will be informed why the information is being collected and how it will be used, or those things will be obvious at that time.
Data and system integrity
The State of Victoria does not represent or warrant that: a.the health Worldl or any content of the health Worldl will be available uninterrupted or error free; or
b.any defects in the health Worldl or any content of the health Worldl will be corrected; or
c.the health Worldl or its supporting systems are free of viruses, malware or other malicious content.
You acknowledge and agree that the State of Victoria will not be liable for any corruption or failed transmission of any information that is attributable to your computer system or to the system of or any act or omission of your Internet Service Provider (ISP).
You acknowledge and agree that you must take your own precautions to ensure that the process which you employ for accessing the health Worldl does not expose you to the risk of viruses or other form of interference that may damage your own computer system.
For the removal of doubt, the State of Victoria does not accept liability for any interference or damage to your computer system which arises in connection with your accessing of the health Worldl or any linked website.
You will ensure that the information you provide to the health Worldl does not contain any viruses, trojan horses, worms, time bombs, cancelbots or other computer programming routines that may damage, adversely interfere with, surreptitiously intercept or expropriate any system or data.
You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the health Worldl.
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. Any dispute arising under these Terms shall be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.
Comments and complaints
the health World welcomes feedback from users and takes complaints seriously. To provide any comments to the health Worldl, please email firstname.lastname@example.org or complete the ‘Contact Us’ form on the website.
If you have a complaint about any aspect of your use of the health Worldl, it is a requirement of these Terms that you notify the Department of Health & Human Services in writing of the complaint, and await a response from the Department of Health & Human Services, before taking any other action or raising the complaint with any external body. The Department of Health & Human Services will act in good faith in investigating and responding to your complaint.
If any of these Terms are determined to be illegal, invalid or otherwise unenforceable, (“Ineffective”), it will be read down to the extent necessary to ensure that it is not Ineffective. If the offending provision cannot be so read down, it will be severed. In any event, the remainder of these Terms shall be interpreted to ensure that all other provisions remain in full force and effect to the greatest extent possible.
